Terms of Use

These Terms of Use ("Terms") govern your use of the Lingavela mobile app and lingavela.com (the "Service"), operated by Anton Bashmakov, an individual based in Thailand, under the Lingavela brand ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. The Service

Lingavela is a language-learning application providing lessons, exercises, AI-assisted feedback, and related content for English, Spanish, and French (with more languages over time).

2. Eligibility & accounts

You must be at least 13 years old to use the Service, or older where required by local law (for example, 16 in the European Union for data-processing consent). If you are under the age of majority in your jurisdiction, you may use the Service only with the consent of your parent or legal guardian. You're responsible for your account credentials and for activity under your account. Provide accurate information and keep it current.

3. Subscriptions, free trial & billing

How does the subscription work?

  • The Service is offered via a 3-day free trial, after which it continues as an auto-renewing weekly subscription at the price shown in the app for your region.
  • Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
  • The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your store account settings.
  • Restore Purchases is available on the paywall and in Settings.
  • Unused trial time is forfeited when you purchase a subscription, where applicable.
  • Prices may change; we'll give notice as required, and changes won't apply to the current paid period.

4. Refunds

Purchases are processed by Apple and Google; refunds are subject to their respective policies. Contact support@lingavela.com and we'll assist where we can.

5. Acceptable use

You agree not to: misuse or disrupt the Service; reverse-engineer or copy it except as allowed by law; use it unlawfully; or abuse the AI features (e.g., to generate harmful, illegal, or abusive content).

6. Intellectual property

The Service and its content (lessons, text, audio, software, branding) are owned by us or our licensors and protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own learning. Content you submit remains yours, but you grant us a license to process it to operate and improve the Service.

7. AI features

AI-generated feedback and responses are provided to support learning and may contain errors. They are not professional, legal, medical, or certified language assessment. Use your judgment.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We don't guarantee specific learning outcomes.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total cumulative liability for any claim arising from the Service shall not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 50. Nothing in these Terms limits liability that cannot be limited under applicable law (for example, statutory consumer-protection rights in the EU, UK, or your local jurisdiction).

10. Termination

We may suspend or terminate access for violations of these Terms. You can stop using the Service and delete your account anytime (see Delete Account).

11. Changes to these Terms

We may update these Terms; continued use after changes means you accept them. We'll update the "Last updated" date and notify you of material changes.

12. Governing law & contact

These Terms are governed by the laws of Thailand, without regard to its conflict-of-law principles. If you are a consumer in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer-protection laws, you also benefit from those protections and may bring claims in your local courts. Any dispute not resolved informally shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand, except where mandatory local law provides otherwise. Questions?
